What is an ALR Hearing?
An ALR hearing, also known as an Administrative License Revocation hearing, is a civil administrative case against your driver's license. It is separate from any court proceedings you may face for your DWI charges, and its main purpose is to challenge the suspension of your driver’s license.
During the hearing, the Administrative Law Judge (ALJ) will listen to the evidence the Department of Public Safety has and will decide whether or not they have proven its case. The judge will suspend your drivers license if they find that the Department of Public Safety has proven its case.
During an ALR hearing, the Department of Public Safety must prove the following:
- There was reasonable suspicion/probable cause to stop and arrest the driver
- The driver was placed under arrest and was given the opportunity to take a breath or blood test
- The driver refused the opportunity to take a breath or blood test or the driver failed by registering a blood alcohol concentration .08 or greater
